Sidewalk Maintenance Policy

The District of Chetwynd cleans, maintains, sweeps and removes snow, ice and other debris from sidewalks that are their responsibility.  This policy outlines the level of service, maintenance and responsibility of the adjacent landowners as it relates to sidewalk maintenance.

The maintenance of the sidewalk on District property within the Shopping Centre is the District’s responsibility.  Differential settlements, frost heaves, and other surface irregularities will be monitored and recorded on a seasonal basis.  Due to climatic conditions, repairs to the sidewalk will only occur between May 15 and September 30 of any given year.  Repair methods will be governed by:

  1. The type of sidewalk failure.
  2. Availability of qualified contractors.
  3. The time of year.
  4. Budgetary constraints.
  5. Location of the sidewalk.

Acceptable means of sidewalk repairs include but is not limited to the following methods:

  1. Removal and Replacement of the Sidewalk.
  2. Resurfacing of the Sidewalk – Asphalt or Concrete.
  3. Milling of Surface Defects.
  4. Closure of the Sidewalk.

Downtown Shopping Centre

Generally, the District of Chetwynd does not remove ice, snow and other debris from sidewalks within the Downtown Shopping Centre.  The Property owners (lessee as the case may be) abutting the sidewalk must ensure that ice, snow and debris are removed from the sidewalk within 48 hours of the deposition.  Failure of the Owner (or lessee) to adequately remove the debris may result in the District of Chetwynd taking whatever means deemed necessary to ensure pedestrian safety and invoicing the Owner accordingly.

The Property Owner (or lessee) shall notify the District of sidewalk defects requiring repair or replacement.  Generally, costs associated with sidewalk repairs and replacement shall be borne by the District unless caused by negligence on the part of the owner, lessee, contractor or agent.

Sidewalks Adjacent to District Property

The District will assume the responsibility for the maintenance and upkeep of Sidewalks adjacent to properties under its control.  Ice, snow and other debris shall be removed within 48 hours following the occurrence.

Sidewalks Adjacent to Private Property

The Property Owners (or lessee) abutting a Sidewalk shall be responsible for the day to day maintenance and upkeep of Sidewalks adjacent to.  Ice, snow and other debris shall be removed within 48 hours following the occurrence. Maintenance does not include replacement of the Sidewalk or any repairs that may be required from time to time.  The Property Owner (or lessee) shall notify the District of sidewalk defects requiring repair or replacement.  Generally, costs associated with sidewalk repairs and replacement shall be borne by the District unless caused by negligence on the part of the owner, lessee, contractor or agent.

Multipurpose Trails, Nature Trails, Hiking Trails

Multipurpose, Nature and Hiking Trails are not maintained by the District throughout the winter.  No ice, snow or debris removal shall occur.  Snow removal will occur on bridges which cross creeks to promote safe passage across water courses (generally within 48 hours of the subsidence of the snowfall).

All maintenance to trails shall occur between May 15 and September 30.
